Abstract

The circular economy represents a shift from the linear “take-make-dispose” model towards a system that emphasises resource efficiency, waste reduction and the restoration of natural systems. However, its implementation requires a regulatory framework that addresses not only economic efficiency and environmental sustainability but also ethical considerations, social justice and intergenerational well-being. This study examines the potential integration of Maqasid al-Shariah principles into Malaysia’s circular economy regulatory framework and proposes an integrative framework suited to the country’s legal and policy context. It adopts a qualitative approach based on doctrinal legal research and document analysis of legislation, policies, and relevant documents concerning the circular economy in Malaysia. The findings indicate that Maqasid al-Shariah principles, particularly the protection of life, intellect, progeny, wealth and the environment, provide a normative foundation for strengthening the ethical and public-interest dimensions of circular economy implementation. Nevertheless, coordination among regulatory instruments, sectoral implementation, and institutional responsibilities requires further strengthening. In response, this study proposes a Maqasid al-Shariah-Based Circular Economy Regulatory Integration Framework that connects the normative principles of Maqasid al-Shariah with circular economy objectives, regulatory instruments, sectoral implementation, and assessable outcomes and impacts. The proposed framework has the potential to support a more ethical, inclusive, and accountable circular economy while strengthening social justice and intergenerational sustainability in Malaysia.
