The Role of Syariah Law of Malaysia In Protecting The Children’s Rights Based on Maqasid Al-Shari’ah

Children are important assets and human resources for a nation. They should be protected from any form of neglect that could impact their future. However, cases involving the neglect of children’s rights in this country is still frequently happened. This study intended to identify child protection theory(ies) based on Maqasid al-Shari’ah and to analyse the application of the identified theory(ies) in the provisions of Syariah law in Malaysia. This qualitative study used the authentic legal research framework that was discusssed in a descriptive and doctrinal manner. The data were in the form of documents and library materials that were analysed using the content analysis method. Findings show that Islam guarantees a total protection of the children’s rights inconsistence with Maqasid al-Shari’ah. Whereas from the Syariah law perspective, Malaysia has provided legal provisions that guarantees the protection of children’s rights that is consistent with Maqasid al-Shari’ah. This study suggests the the society’s understanding on the protection of children’s rights should always be empowered. In addition, there should be continous enforcement of the existing legal provisions in order that children’s rights are incessantly protected in line with Maqasid al-Shari’ah.
