Abstract

Perkahwinan melibatkan kanak-kanak merupakan satu perkara yang bukan sahaja berlaku di Malaysia, malah di serata dunia.  Berdasarkan kepada kajian yang telah dijalankan, terdapat pelbagai kesan negatif perkahwinan kanak-kanak dari aspek psikologi dan kesihatan. Malah, kanak-kanak yang berkahwin juga menghadapi cabaran bukan sahaja dari sudut psikologi dan kesihatan fizikal, malah cabaran penyesuaian diri dalam rumahtangga dan kebarangkalian untuk perceraian juga adalah tinggi. Pelbagai usaha telah dilakukan bagi membendung perkahwinan kanak-kanak supaya kemudaratan yang disebabkan oleh perkahwinan tersebut dapat dielakkan. Hasil daripada usaha yang telah dijalankan, didapati penurunan di dalam statistik yang melibatkan perkahwinan kanak-kanak. Namun begitu, perkahwinan ini masih berlaku kerana undang-undang sedia ada hakikatnya tidak dapat menghalang perkahwinan bawah umur secara mutlak. Di Malaysia, mereka yang ingin berkahwin adalah diwajibkan menduduki Kursus Pra-perkahwinan Islam yang bertujuan untuk memberi pendedahan mengenai hak-hak dan tanggungjawab dalam perkahwinan. Namun begitu, kandungan kursus dan cara perlaksanaannya adalah bersifat umum kepada semua lapisan masyarakat. Artikel ini bertujuan untuk menganalisis kesesuaian Modul Bersepadu Kursus Pra-perkahwinan Islam terhadap pemohon perkahwinan bawah umur dan sejauh mana aspek penjagaan nyawa (hifz al-nafs) dalam modul ini dapat membantu kanak-kanak dalam menolak kemudaratan yang mungkin berlaku dalam perkahwinan. Kajian ini menggunakan kaedah analisis dokumen dengan menganalisis kajian-kajian lepas yang berkaitan dengan perkahwinan bawah umur khususnya di Malaysia, dan Modul Bersepadu Kursus Pra-perkahwinan Islam (MBPKI). Artikel ini menyimpulkan bahawa Modul Bersepadu Kursus Pra-Perkahwinan Islam yang sedia ada menekankan aspek penjagaan nyawa (hifz al-nafs) dan bersesuaian dengan pemohon perkahwinan bawah umur. Namun begitu, adalah dicadangkan agar diteliti cara perlaksanaan dan penyampaian kursus pra-perkahwinan Islam terhadap kanak-kanak agar kursus yang disampaikan adalah berkesan dan dapat membantu dalam menolak kemudaratan terhadap kanak-kanak yang terlibat dalam perkahwinan tersebut.

Child marriage is not only an issue in Malaysia but occurs worldwide. Numerous studies have shown the negative effects of child marriage, particularly in terms of psychological and health impacts. Children who marry face challenges not only from a psychological and physical health perspective but also in terms of adjusting to marital life, with a higher probability of divorce. Various efforts have been made to curb child marriage to mitigate the harm associated with it. As a result of these efforts, there has been a decline in the statistics related to child marriage. However, such marriages still occur, as existing laws do not entirely prevent underage marriages. In Malaysia, individuals who wish to marry must attend an Islamic Pre-Marriage Course, which aims to educate them about their rights and responsibilities in marriage. However, the content of the course and its delivery are designed for the public and do not specifically address the unique needs of underage marriage applicants. This article aims to analyze the suitability of the Integrated Islamic Pre-Marriage Course Module for underage marriage applicants and to what extent the aspect of preserving life (hifz al-nafs) within the module can help protect children from the potential harm of marriage. This study employs document analysis by reviewing previous research on child marriage, particularly in Malaysia, and analyzing the Integrated Islamic Pre-Marriage Course Module (MBKPI) content. The article concludes that the existing module does emphasize the preservation of hifz al-nafs and is generally suitable for underage marriage applicants. However, it is recommended that the implementation and delivery methods of the Islamic pre-marriage course be tailored to better cater to children. This will ensure that the course is effective and can help mitigate the harm associated with child marriage.
